FINDINGS OF FACT
AND CONCLUSIONS OF LAW
On July 19, 1988, pursuant to public notice as required by law,
this matter having come before the Eagle Planning and Zoning of
the City of Eagle, Idaho, for public hearing upon the application
of Dave Beggrow, as represented by Dennis McCracken, for
consideration of a Conditional Use Permit for a Day Care Center,
located in Eagle Hills Subdivision.
After hearing testimony from the applicant and interested parties
"and being advised in the matter, the Eagle Planning and Zoning
recommended a continuation of the meeting until the next
regularly scheduled P&Z meeting in order to give the applicant
more time to prepare a more thorough report for the Commission.
On August 2, 1988, the Eagle Planning and Zoning Commission
reopened the public hearing continued on July 19, 1988.
After hearing testimony given from the applicant and from the
community in general, the Eagle Planning and Zoning Commission
recommends to the City Council the following
FINDINGS OF FACTS AND CONCLUSIONS OF LAW:
1.
Denial of the application of a Conditional Use Permit based
on the Eagle City Code, Title 8-7-3-2, General Standards for
Conditional Uses, under the following sections:
C.
Will be designed, constructed, operated and maintained
to be harmonious and appropriate in appearance with the
existing or intended character of the general vicinity
and that such use will not change the essential
character of the same area;
D.
Will not be hazardous or disturbing to existing or
future neighboring uses;
H.
Will have vehicular approaches to the property which

shall be so designed as not to create an interference
with traffic on surrounding public thoroughfares.
