Findings - PZ - 1988 - Quarter Circle DJ Ranch - Correct A Annexation In Limbo CITY OF EAGLE In the Matter of ) ) Quarter Circle) DJ Ranch) FINDINGS OF FACT AND CONCLUSIONS OF LAW FINDINGS OF FACT On July 5, 1988 the Eagle Planning and Zoning conducted a public hearing concerning a zoning application initiated by the City of Eagle. The City found it necessary to zone the proper~y known to be the Quarter Circle DJ Ranch. This area had been annexed in 1981 but had not. been recognized by the State of Idaho Taxation as the property's legal description had been incorrect, therefore, the annexation had been in limbo. In correcting the legal description, now set forth in Ordinance #132, it was discovered that the zoning had been neglected also. In that the area within the City of Eagle exceeded 261 acres it was necessary to conduct public hearings. The hearing was conducted pursuant to the notice and hearing procedures set forth in Section 67-6509, Idaho Code and Title 8 Section 7-4-(2-4) of the Eagle City Code. At the hearing, testimony was received Shelly Rambo, area resident, she desires the area zone to be "A" Agricultural. There was no opposition. Based upon the findings in the Eagle Comprehensive Plan under Land Use and Hazard Areas that speak to the density and land use of the area, and the Eagle City Code 8-2-1, defining Agricultural zones, the Eagle Planning and Zoning concluded the following: l. The section of land known to be the Quarter circle DJ Ranch, a ranch that consists of approximately 261 acres within the city of Eagle, is now used for Agricultural purposes; 2. That the ranch is in the 100 year flood area; 3. Meets the criteria set forth in the Eagle Comprehensive Plan and City Codes for "A" Agricultural zoning; FINDINGS OF FACTS AND CONCLUSIONS OF LAW PAGE 2 4. That the records in this matter indicate all notices, public hearings and publications have occurred as required by law~ 5. The records further reflect that public and private entities have been notified of the proposed zoning hearing and responses recorded. 6.
