Bass In the Matter of ) ) ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW Applicant FINDINGS OF FACT On February 2, 1988, the Eagle Planning and Zoning Commission conducted a public hearing concerning a rezone application submitted by Glenn D. Bass to rezone nine acres of land from A Agriculture to a commercial zone. The hearing was conducted pursuant to the notice and hearing procedures set forth in Section 67-6509, Idaho Code. At the hearing, testimony was received from the applicant, Glenn D. Bass, and from Pat Towne, in favor of the rezone. There was no opposition to the proposal. Mr. Bass stated that the reason for the rezone request was to establish a yardage shop, and later another small business. Mr. Bass suggested a Quick-Lub may be his choice, but that he wants the back portion of the land to remain his home and that he intends to remain grazing livestock, as he is now. Based upon testimony at the public hearing together with all documentary evidence submitted concerning the application the P&Z Commission makes the following Findings of Fact and Conclusions of Law: 1. The Applicant, Glenn D. Bass, has filed an application for rezone in order to establish a business and develop his property into a commercial venture. 2. The applicant has proposed two businesses he now has in mind for the area. 3. The records in this matter indicate all notices, public hearings, and publications have occurred as required by law. The records further reflect notice of the proposed change appropriate to the public and private entities with responses having been received from those entities. 4. The Planning and Zoning Commission finds that the proposed FINDINGS OF FACT AND CONCLUSIONS OF LAW/BASS Page 2 rezone fulfills the purposes of zoning development as set forth in Title 8, Eagle City Code. 5. The Planning and Zoning Commission finds, based upon the facts submitted to it, that the proposed commercial development can be justified at the location proposed. 6. The Planning and Zoning Commission finds, based upon the land use requested by the applicant, that the most appropriate zoning for the property should be C-1, Neighborhood Business District. 7. The Planning and Zoning Commission finds, based upon the facts submitted to it, that the proposed land use is in general conformance with the Comprehensive Plan.
