RIGHT -OF-WAY -AGREEMENT

designated as the grantors, and The City of Eagle, a municipa corporation formed under the
laws of the State of Idaho, 310 East State Street, City of Eagle, County of Ada, State of Idaho,
hereinafter designated as the grantee;
WITNESSETH: That the grantors in consideration of the sum of One Dollar and other
valuable considerations, do hereby grant and convey unto the grantee, its successors and
assigns, a permanent easement for the installation and continued operation, maintenance,
repair, inspection, alteration and replacement of a water pipe line and necessary
appurtenances, together with a perpetual ingress and egress easement, under, on, and across
the following described real property belonging to the said grantors:

TO HAVE AND TO HOLD the same unto the grantee, its successors and assigns,
FOREVER.
The grantee covenants with the grantors, their Successors and assigns, that the
grantee will restore the surface of the ground in as good a condition as when entered upon by
the grantee and its agents. The grantee further covenants with the grantors that it will restore
the surface of the ground in as good a condition as when entered upon by the grantee and its
agents, after any repairing or maintaining of said water pipe line.

Water Line Easement
6,453 Square Feet
A 20 foot wide easement located within a portion of Lot 20, Block 1 of Bogus Ridge Subdivision
(a recorded subdivision on file in Book 60 of Plats at Page 5981, records of Ada County, Idaho), being
within a portion of Seétion 3, Township 4 North, Range 1 East, Boise Meridian, City of Eagle, Ada
County, Idaho, lying 10 feet either side of the following described centerline.
Commencing at the Southwest Comer of said Lot 20, thence easterly along the southerly line of
said Lot 20 South 89°-41 '-49" East a distance of38.84 feet to the centerline of said easement and the
POINT OF BEGINNING.
Thence leaving said southerly line North 21 °-00' -00" West a distance of 10.73 feet to a point;
Thence along a line parallel to and 10 feet perpendicular from said southerly line
South 89°-41' -49" East a distance of 129.66 feet to a point;
Thence North 00°-11 ' -19" West a distance of 182.98 feet to a point on the northerly line of said
Lot 20, said point being the POINT OF TERMINUS.
The sidelines of said easement shall be lengthened or shortened so as to form a closed figure and
to terminate on the northerly and southerly lines of said Lot 20.
The above described tract ofland contains 6,453 square feet, more or less, subject to all existing
easements and rights-of-way.
