RIGHT -OF-WAY -AGREEMENT
THIS INDENTURE made this 22nd day of March , 19.2L,
between LEXINGI'ON HILLS, INC. of EAGLE, ID , hereinafter
designated as the grantors, and The City of Eagle, a municipal corporation formed under the
laws of the State of Idaho, 310 East State Street, City of Eagle, County of Ada, State of Idaho,
hereinafter designated as the grantee;
WITNESSETH: That the grantors in consideration of the sum of One Dollar and other
valuable considerations, do hereby grant and convey unto the grantee, its successors and
assigns, a permanent easement for the installation and continued operation, maintenance,
repair, inspection, alteration and replacement of a water pipe line and necessary
appurtenances, together with a perpetual ingress and egress easement, under, on, and across
the following described real property belonging to the said grantors:

TO HAVE AND TO HOLD the same unto the grantee, its successors and assigns,
FOREVER.
The grantee covenants with the grantors, their successors and assigns, that the
grantee will restore the surface of the ground in as good a condition as when entered upon by
the grantee and its agents. The grantee further covenants with the grantors that it will restore
the surface of the ground in as good a condition as when entered upon by the grantee and its
agents, after any repairing or maintaining of said water pipe line.

Water Line Easement
4,946 Square Feet
A 20 foot wide water line easement situated in a portion of Lot 45, Block 12 of Lexington Hills
No. 11 Subdivision (a recorded subdivision on file in Book 77 of Plats at Pages 8120 through 8122,
records of Ada County, Idaho), being within a portion of Section 3, Township 4 North, Range 1 East,
Boise Meridian, City of Eagle, Ada County, Idaho, said easement lying contiguous to and westerly of the
common lot line between Lot 46 and said Lot 45 of said Lexington Hills No. 11 subdivision.
The sidelines of said easement shall be lengthened or shortened so as to form a closed figure and
to terminate on the northerly right-of-way of East Aspenwood Court and the northerly boundary of said
Lexington Hills No. 11 Subdivision.
The above described tract of land contains 4,946 square feet, more or less, subject to all existing
easements and rights-of-way.
