I believe this water right liœnse goes with the well at the old Lions
Park on Eagle Ibad. This property was leased to the City of Eagle fran
Eagle Sewer District, wOO at one tine CMIled the property. The City turned
the Park back to the Sewer District when they developed Hill Side Park.
'!he Sewer District then sold the property to res & Sue Cullen. In the
process of a divorce she (Sue) ended up as sole owner of the Park.
At the tine the Park was sold the Sewer District was in litigation over
a property line dispute, with Boise Valley Packing. '!he buyer (Cullen)
knew of the litigation at the tine he bought the property.
Judgerænt on the litigation was in favor of Boise Valley Packing, there
fo:œ they ended up as owner of the well site on the (Old Lions Park).
Sorœwhe.re behveen the Cities leasing of the Park and Boise Valley Packing
ending up as owner of the well site, the DePartrœnt of Water Resources
ended up with their :œoords sOOwing the site belonging to the City of
Eagle, when in fact it ébes not and never did.

THE CITY OF EAGLE, IDAHO, a municipal corporation, 310 E. State Street, P.O.
477, Eagle, Idaho 83616, the GRANTORS, for consideration given in the amount of
one dollar, and other good and valuable considerations, the receipt whereof is
hereby acknowledged, do hereby grant, bargain, sell, and convey unto James E.
Bruce, Jr. and Lois 1. Bruce, husban.d and wife, 428 Cashmere Road, Boise,
Idaho 83702, their Successors and assigns, an easement in, over and upon the
following described land situated in the City of Eagle, County of Ada, State
of Idaho, to wit:
A strip of land 5 feet wide by 140 feet in length, being the Westerly
5 feet of Lot 10, Block 5 of Carpenters Addition to the Townsite of Eagle,
Ada County, Idaho as recorded under Instrument No. 14116 in the office of
the Ada County Recorder, and said strip of land extending from the Southerly
boundary line of Idaho Street to the Northerly boundary of the alley between
Idaho and State Streets,
for the purpose of constructing, operating, maintaining, and repairing or
replacing underground water service pipelines and appurtenances and accessories,
including excavating and refilling trenches and ditches, to provide central
city water service to the grantees properties located along the alley between
Idaho and State Streets.
There is also granted the right of ingress and egress, over and upon the above
described strip of land and other adjacent lands belonging to the GRANTORS,
for the above described purposes.
There is also granted a temporary construction easement fifty (50) feet in
width along the easement side of the GRANTORS property line, on as much land
as is owned by the GRANTOR, which is not occupied by buildings or permanent
structures or improvements, for the purpose of constructing said pipelines
and appurtenances, which shall extinguish at such time as construction has
been completed, or three (3) years from the date hereof, whichever date comes
first.
The GRANTEE shall be responsible and shall replace any landscaping disturbed
or destroyed when working on or replacing or repairing GRANTEES water pipe-
lines or appurtenances. .
There is reserved to the GRANTORS, their heirs and assigns, the right to use
the easement area lands above described, at all times and for all purposes not
inconsistent with the full use and enjoyment of said easement by the GRANTEE,
their Successors and assigns, except that no permanent buildings or structures
shall be placed in the easement area unless written consent of GRANTEE has
first been obtained.

Non use of the water service pipelines in this easement area, by the GRANTEE.
for a period of three (3) years time, shall void this easement, upon proper
notice to GRANTEE and recorded declaration by the GRANTOR, of such abandonment
of use. ,
TO HAVE AND TO HOLD the aforesaid easement, in, over and upon the above described
land of the GRANTOR, with all rights, privileges and appurtenances thereto
belonging or in anywise appertaining, unto the GRANTEE. its successors and
assigns until such time as the area may no longer be used for the purposes
