the GRANTOR, does hereby grant, bargain, sell and convey unto the ADA COUNTY
HIGHWAY DISTRICT, a Body Politic and Corporate of the State of Idaho, the GRANTEE,
whose address is 318 East 37th Street, Boise, Idaho 83714, an PERMANENT EASEMENT for
the pm:pose of construction and placement of meandering public sidewalks. over and under the
following described real property located in the County of Ada, State of Idaho, to-wit:
A tract of land situated in a portion of the South Y4 comer of Section 9, TAN" R.1E" Boise
Meridian, City of Boise, Ada County, Idaho, described as follows:

IT IS UNDERSTOOD AND AGREED that the rights hereby granted are subject to the
following conditions, to-wit:
1, That after construction and placement of improvements, the Grantee, or its
authorized representative shall thereafter have and retain the rights of ingress/egress necessary for
maintaining same, Above described premises shall be restored as near as possible to their former
condition after construction and placement of storm drain facilities.
2, That the grant of this easement shall run with the land and shall be binding and inure
to the benefit of the parties hereto, their heirs, successors' and/or assigns.
3. That said Grantor does hereby covenant to and with the said Grantee, that they are
the owners in fee simple of said premises; that said premises are free from all encumbrances, and
that they will warrant and defend the same from all lawful claims whatsoever.

Beginning at the South Y4 corner of Section 9, TAN., R.1E., B.M., Ada County, Idaho;
thence North 00003'50" East along the North-South center section line, 922.19 feet to a 0/8
inch iron pin on the northerly right-of-way of State Street; thence continuing North 00003'50"
East along said North-South center section line, 806.53 feet to an iron pin; thence South
61~6'26" West, 62.66 feet to a point on the westerly right-of-way line of North Palmetto
Avenue, said point also being a point on the southerly boundary of Eagle Village
Subdivision; thence following said subdivision boundary South 61°41'24" West, 39,60 feet to
a point; thence North 8go48'34" West, 599.82 feet to a point; thence South 6e34'50" West,
