FININGS OF FACT
AND CONCLUSIONS OF
LAW
On November 13, 1990, pursuant to public notice and hearing
procedures set forth in Section 67-6509, Idaho State Code, Lyle
Pope, the applicant, came befqre the Eagle Council for the City
of Eagle, Idaho, requesting consideration for a rezone from R5 to
R16, and set back variances from 25 foot set backs to 10 foot set
backs in the rear on the East side of the property, and from 20
foot set backs to 7 1/2 on the East and West of the long lot.
The Eagle City Council deferred a decision on this application
based on the lack of information provided, and asked for
information including a site plan complete with landscaping,
parking lot configuration, sidewalks and traffic flow.
On December II, 1990, the applicant, Lyle Pope, returned to City
Council pursuant to plublic notice and hearing procedures for
consideration of his proposal.
Based on testimony from the applicant and all interested parties,
together with all documentary evidence submitted concerning the
application, the Eagle City Council finds the following:
FINDINGS OF FACT AND CONCLUSIONS OF LAW:
1.
The records in this matter indicate all notices, and
publications have occurred as required by law. the records
further reflect notice of the public hearing was sent to the
appropriate public and private entities with responses to
the proposal being received in the City Clerk's office from
those entities;
2.
On December 11, 1990 public hearing proceedings were
conducted by the Eagle City Council. Testimony was
received;
3.
The application submitted by Lyle Pope for a rezone and
variance complies with the requirements set forth in the
Eagle City Code, Title 8 and 9 and the Eagle Comprehensive
Plan;
4.
The granting of a rezone and variance will not violate the
Idaho Code nor nullify the interest or purpose of the Eagle
City Code, or Eagle Comprehensive Plan.
5.
Based upon the foregoing findings of facts the Eagle City
Council concludes that the application be granted.
On December 11, 1990, The Eagle City Council, voted to
approve the application. (time), (conditions).
ADOPTED by the Eagle City Council of the City of Eagle, Idaho.
