Findings - CC - 1990 - - Edgewood Subidvision CITY OF EAGLE In the Matter of: ) ) ) ) FINDINGS OF FACTS & CONCLUSIONS OF LAW EDGEWOOD SUBDIVISION On February 27, 1990 pursuant to public notice and hearing procedures set forth in Section 67-6509 of the Idaho Code, this matter came before the Eagle City Council of the City of Eagle, Idaho, a hearing upon the request of Melvin and Ida Lindsay owners of said property. Representative for the owners, Craig Van Engelen, presented the plan for annexation and R-4 zoning. The property is located at the corner of Edgewood and Floating Feather Road. The proposal is a 40 acre subdivision. Based on testimony from the applicant and interested parties together with all documentary evidence submitted concerning the application, the Eagle City Council finds the following: FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. The records in this matter indicate all notices, and publications have occurred as required by law. The records further reflect notice of the proposed annexation and zoning was sent to the appropriate public and private entities with no responses objecting to the proposal being received from those entities. 2. On February 5, 1990 the Eagle Planning and Zoning conducted public hearing proceedings. No opposing testimony was received. 3. Based upon documentation the Eagle Planning and Zoning the Eagle City Council concludes that the application for annexation and zoning meets the requirements of Idaho State Code. (50-222) 4. The Eagle City Council further concludes that the proposed annexation and zoning application meets the requirements of Title 8, Chapter 8, Section 2, ANNEXATION LIMITED TO AREA OF IMPACT, and Tile 1, Chapter 10, Section 2, BOUNDARIES OF CITY- ANNEXATION of the Eagle City Code.
