FINDINGS OF FACTS
& CONCLUSIONS OF
LAW
MCCALLUM ANNEXATION AND
ZONING
On March 27, 1990 pursuant to public notice and hearing
procedures set forth in Section 67-6509 of the Idaho Code, this
matter came before the Eagle City Council of the City of Eagle,
Idaho, a hearing upon the req~est of John and Kathryn MCCallum
owners of said property. Larry Sale, representative the property
owners, presented the plan for annexation and R-1 zoning. The
property is located South of Beacon Light Road and West of
Highway 55. The proposal is for single family dwelling units.
Based on testimony from the applicant and interested parties
together with all documentary evidence submitted concerning the
application, the Eagle City Council finds the following:
FINDINGS OF FACT AND CONCLUSIONS OF LAW:
1. The records in this matter indicate all notices, and
publications have occurred as required by law. The records
further reflect notice of the proposed annexation and zoning was
sent to the appropriate public and private entities with no
responses objecting to the proposal being received from those
entities.
2. On March 19, 1990 the Eagle Planning and Zoning conducted
public hearing proceedings. All public testimony was received at
that time.
3. Based upon documentation the Eagle Planning and Zoning the
Eagle City Council concludes that the application for annexation
and zoning meets the requirements of Idaho State Code. (50-222)
4. The Eagle City Council concludes that the proposed
annexation and zoning application meets the requirements of Title
8, Chapter 8, Section 2, ANNEXATION LIMITED TO AREA OF IMPACT,
and Tile 1, Chapter 10, Section 2, BOUNDARIES OF CITY-
ANNEXATION of the Eagle City Code.
5. The Eagle City Council further concludes that the area be
declared an area of critical concern, as provided for in Title 9,
Chapter 5, Section 8 of the Eagle City Code.
