Findings - CC - 1990 - - Riverstone Pud/Rezone CITY OF EAGLE IN THE MATTER OF RIVERSTONE, AN APPLICATION FOR A PUD!REZONE ) ) ) FINDINGS OF FACT AND CONCLUSION OF LAW On July 24, 1990, pursuant to public notice and hearing procedures set forth in Section 67-6509, Idaho State Code, Robert DeShazo and Rowland Jones, the applicants, came before the Eagle City Council for the City. of Eagle, Idaho, requesting consideration for a Planned Unit Development and Rezone application. Based on testimony from the applicant and all interested parties, together with all documentary evidence submitted concerning the application, the Eagle City Council finds the following: FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. 2. The records in this matter indicate all notices, and publications have occurred as required by law. the records further reflect notice of the public hearing was sent to the appropriate public and private entities with responses to the proposal being received in the City Clerk's office from those entities; On July 24, 1990 public hearing proceedings were conducted by the Eagle City Council. Testimony received was received; 3. The application submitted by the representatives for Riverstone Townhouses for a PUD/Rezone to R9 complies with the requirements set forth in the Eagle City Code, Title 8- 6, 8-7-2, Title 9-5-4 and the Eagle Comprehensive Plan; 4. The granting of a PUD/Rezone (R9) will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code, or Eagle Comprehensive Plan with conditions set forth by the Eagle City Council; 5. Based upon the foregoing findings of facts the Eagle City Council concludes that the application be granted with conditions; 6. On July 24, 1990, The Eagle City Council voted to approve the application with the attached conditions. ADOPTED by the Eagle City Council of the City of Eagle, Idaho. This 11 day of September , 1990.
