Findings - CC - 1990 - - Eagle Ridge Subdivision/Consideration For Variance CITY OF EAGLE IN THE MATTER OF EAGLE RIDGE SUBDIVISION FOR VARIANCES ) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW On September 11, 1990, pursuant to public notice and hearing procedures set forth in Section 67-6509, Idaho State Code, Greg Johnson, the applicant, came before the Eagle City Council for the City of Eagle, Idaho, requ~sting consideration for variances. Based on testimony from the applicant and all interested parties, together with all documentary evidence submitted concerning the application, the Eagle City Council finds the following: FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. The records in this matter indicate all notices, and publications have occurred as required by law. the records further reflect notice of the public hearing was sent to the appropriate public and private entities with responses to the proposal being received in the City Clerk's office from those entities; 2. On August 20, 1990 public hearing proceedings were conducted by Eagle Planning and zoning. Planning and Zoning recommended approval to the City Council. September 11, 1990 public hearing proceedings were conducted by the Eagle City Council. Testimony received was favorable. 3. The application submitted by Greg Johnson for the following variances: 1. Block 9, lots 1,2, variance rear set back to 15 ft 2. Block 4, lots 26~32, variance rear set back to 15 ft 3. Block 10, lots 1,2, variance rear set back to 15 ft 4. all front yard and street side minimums of 15 ft variance from back of curb (25 lots) All the requested variances comply with the requirements set forth in the Eagle City Code, Title 8 and the Eagle Comprehensive Plan; 4. The granting of variances will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code, or Eagle Comprehensive Plan. 5. Based upon the foregoing findings of facts the Eagle City Council concludes that the variances be conditionally granted. On September 11, 1990, The Eagle City Council, voted to approve the application for variances with the following conditions: 1. front portion of lots: 10 ft. set back from property line 2. rear portion of lots: IS ft on N. boundary only 3. all roads completed ADOPTED by the Eagle City Council of the City of Eagle, Idaho 6. this day of , 1990.
