Findings - CC - 1989 - NA - Annexation And R-5 Zoning CITY OF EAGLE In the Matter of: FINDINGS OF FACTS & CONCLUSIONS OF LAW JOPLIN RANCH ANNEXATION On September 12, 1989, pursuant to public notice and hearing procedures set forth in Section 67-6509 of the Idaho Code, this matter came before the Eagle C~ty Council, City of Eagle, Idaho, a hearing upon the request of Robert Donovan, Representative of Kevin Joplin dba Joplin Ranch, owner of the property, for annexation and R-5 zoning. The property is located on the East side of North Eagle Rd., south of the City Limits and consists of 140 acres of land. Based on testimony from the applicant and interested parties together with all documentary evidence submitted concerning the application, the Eagle City Council finds the following: FINDINGS OF FACT AND CONCLUSIONS OF LAW: 1. The records in this matter indicate all notices, and publications have occurred as required by law. The records further reflect notice of the proposed annexation and zoning was sent to the appropriate public and private entities with no responses objecting to the proposal being received from those entities. 2. On September 12, 1989 the Eagle City Council conducted public hearing proceedings. No opposing testimony was received. 3. Based upon documentation the Eagle City Council concludes that the application for annexation and zoning meets the requirements of Idaho State Code. (50-222) 4. The Eagle City Council further concludes that the proposed annexation and zoning application meets the requirements of Title 8, Chapter 8, Section 2, ANNEXATION LIMITED TO AREA OF IMPACT, and Tile 1, Chapter 10, Section 2, BOUNDARIES OF CITY-ANNEXATION of the Eagle City Code.
