Findings - CC - 1989 - - Conditional Use Permit For 555 N Eagle Rd CITY OF EAGLE ) ) ) In the Matter of: SSe FINDINGS OF FACTS AND CONCLUSIONS OF LAW St. Mathews Catholic Church On October 10, 1989, pursuant to public notice and hearing procedures set forth in Section 67-6509 of the Idaho State Code, this matter came before the Eagle City Council for the City of Eagle, Idaho. The hearing was requested by Wayne Adams for a Conditional Use Permit in order to establish St. Mathews Catholic Church on the property located at 555 N. Eagle Rd. Mike Jones, representative of the church and Wayne Adams, owner of the property, presented the proposal at the hearing. Based on testimony from the applicant and interested parties, together with all documentary evidence submitted concerning the applicant, the Eagle City Council finds the following; FINDINGS OF FACTS AND CONCLUSIONS OF LAW: 1. 2. The records in this matter indicate all notices, and publications have occurred as required by law. The records further reflect notice of the proposed conditional use permit was sent to the appropriate public and private entities with no responses objecting to the proposal being received from those entities; On September 18, 1989 public hearing proceedings were conducted with Eagle Planning and zoning Commission. Testimony was favorable. 3. The application by St. Mathews Catholic Church for a Conditional Use Permit complies with the Eagle City Code Title 8, Section 7-3-2, the General Standards for Conditional Use. 4. In compliance with Title 8, Section 7-3-5 (d) Conditions of Permit, the Planning and zoning Commission concluded that it would be in the best interest of the project to monitor the sequence and timing of the development by recommending to Council that the progress be monitored by the Design Review Committee through each phase. 4. The granting of the Conditional Use Permit will not violate the Idaho Code nor nullify the interest or purpose of the Eagle City Code or Eagle Comprehensive plan with the conditions recommended by the Eagle Planning and Zoning Commission 'and approved by the City Council. 5. Based upon the foregoing Findings of Facts and Conclusions of Law the Eagle City Council concludes that the Conditional Use Permit for St. Mathews Catholic Church be granted, with the following conditions: That there is a review of the Design Review Committee at each phase; Approval is given by the Bishop and Wayne Adams, owner of the property; That it is extended over a period of 5 years. 6. It is the desire of the Co~ncil that more detailed plans be presented at each phase, especially the transportation plans. DATED this ~L d.ay of October, 1989.
