FINDINGS OF FACT AND
CONCLUSIONS OF LAW

FINDINGS OF FACT
On February 9, 1988, the Eagle City Council conducted a public
hearing concerning a rezone application submitted by Glenn D.
Bass to rezone nine acres of land from A Agriculture to a
commercial zone. The hearing was conducted pursuant to the
notice and hearing procedures set forth in Section 67-6509, Idaho
Code and 8-7-5, Eagle City Code.
At the hearing, testimony was received from the applicant, Glenn
D. Bass, in representation of the request for rezone. There was
no opposition to the proposal.
Mr. Bass stated that the reason for the rezone request was to
establish a yardage shop, and later another small business. Mr.
Bass suggested a Quick-Lub may be his choice, but that he wants
the back portion of the land to remain his home and that he
intends to remain grazing livestock, as he is now.
Based upon testimony at the public hearing together with all
documentary evidence submitted concerning the application the
Eagle City Council made the following Findings of Fact.
1. The Applicant, Glenn D. Bass, has filed an application for
rezone in order to establish a business and develop his property
(legal specified in rezone application, submitted February 9,
1988) into a commercial venture.
2. The applicant has proposed two businesses he now has in mind
for the area.
3. The records in this matter indicate all notices, public
hearings, and publications have occurred as required by law. The
records further reflect notice of the proposed change appropriate
to the public and private entities with responses having been
received from those entities.

4. The Eagle City Council finds that the proposed rezone
fulfills the purposes of zoning development as set forth in Title
8, Eagle City Code.
5. The Eagle City Council finds the relevant criteria and
standards for consideration of the Glen D. Bass rezone
application as set forth in the comprehensive plan and in Title
8, 2 & 7 of the Eagle City Code.
6. The Eagle City Council finds, based upon the facts submitted
to it, that the proposed commercial development is reasonable and
considers the general welfare of the community in the location
proposed.
6. The Eagle City Council finds, based on the recommendations of
the Eagle Planning and Zoning to approve the application and to
zone the property C-1 Neighborhood Business District, that the
application for zoning is in accordance with Title 8, Eagle City
Code.
7. The Eagle City Council finds, based upon the facts submitted
to it, that the proposed land use is in accordance with the
Comprehensive Plan.
CONCLUSIONS OF LAW:
Based on the foregoing Finding of Fact and Conclusions of Law the
Eagle City Council hereby makes and enters the following
decision:

1. The recommendations of the Eagle Planning and Zoning in this
matter are hereby adopted in the zoning application for zone
change to designate the Glen D. Bass property, under
consideration, herein to C-l Neighborhood Business District, and
is hereby granted.
