FINDINGS OF FACT
AND CONCLUSIONS OF LAW
On July 19, 1988, pursuant to public notice as required by law,
this matter having come before the Eagle City Council of the City
of Eagle, Idaho, for public hearing upon the application of Kim
Ash and Doylene DeVer, partners in business, for consideration of
a Conditional Use Permit for a craft shop on Eagle Road in Eagle,
Idaho.
After hearing testimony from the applicant and interested parties
and being fully advised in the matter, the Eagle City Council
now makes the following:
FINDINGS OF FACTS AND CONCLUSIONS OF LAW
1. Applicant has applied for approval of a Conditional Use
Permit.
2.
All legal requirements for notice of public hearing have
been met.
3.
Relevant criteria and standards for consideration of this
application are set forth in sections 8-5-2, Eagle City Code,
NonConforming Uses-Authority to Continue Nonconforming, and
sections 8-7-3-2, General Standards for Conditional Use.

The business will be harmonious with the Comprehensive Plan.
Will be operated and maintained to be harmonious and
appropriate in appearance with the existing character
of the general vicinity, and that such use will not
change the essential character of the same area.

Will not create excessive additional requirements at
public cost for public facilities.

Will have vehicular approaches to the property which shall
be so designed as not to create an interference with traffic
on surrounding public thoroughfares.
CONCLUSION OF LAW:
1.
The Conditional Use Permit is approved by the Eagle City
Council, subject to the codes numbered 1 through 6 under
Findings of Facts.
A Conditional Use Permit for the use of a craft shop at the
location of 209 S. Eagle Rd. is hereby granted.
