Findings - CC - 1988 - Correction of legal and zoning descrepancy - Zone Quarter Circle Dj Ranch CITY OF EAGLE In the Matter of ) ) Quarter Circle) DJ Ranch) FINDINGS OF FACT AND CONCLUSIONS OF LAW FINDINGS OF FACT On July 12, 1988 the Eagle City Council conducted a public hearing concerning a zoning application initiated by the City of Eagle. The City found it necessary to zone the property known to be the Quarter Circle DJ Ranch, an area that had been annexed in 1981 but had not been recognized by the State of Idaho Department of Taxation. The property's legal description had been incorrect, and the City of Eagle was asked to correct the problem. In correcting the legal description, now set forth in Ordinance #132, it was discovered the property had not been zoned. A public hearing was conducted pursuant to the notice and hearing procedures set forth in Section 67-6509, Idaho Code and Title 8 Section 7-4-(2-4) of the Eagle City Code. At the hearing, testimony was heard by Don Knickrehm, a resident of the area. Mr. Knickrehm would like to see the area zoned Agricultural. There was no opposition. Based upon the findings in the Eagle Comprehensive Plan under Land Use and Hazard Areas that speak to the density and land use of the area, and the Eagle City Code 8-2-1, defining Agricultural zones, the Eagle Planning and Zoning recommended that the land should be zoned "A" Agricultural. The Eagle City Council concluded the following: I. The section of land known to be the Quarter circle DJ Ranch, a ranch that consists of approximately 261 acres within the city of Eagle, is now used for Agricultural purposes; 2. Meets the criteria set forth in the Eagle Comprehensive Plan and City Codes for "A" Agricultural zoning; FINDINGS OF FACTS AND CONCLUSIONS OF LAW PAGE 2 3. That the records in this matter indicate all notices, public hearings and publications have occurred as required by law. The records further reflect that public and private entities have been notified of the proposed zoning hearing and responses recorded. 4. The Eagle City Council concludes that the land known as the Quarter Circle DJ Ranch be zoned "A" Agricultural. I (" day of Or' 1988, by the 'Eagle City ADOPTED this Council. '-..
