FINDINGS OF FACT
AND CONCLUSIONS OF LAW
On September 27, 1988, pursuant to public notice as required by
law, this matter having come before the Eagle City Council
of the City of Eagle, Idaho, for public hearing upon the
application of BanBury Subdivision, as Represented by Larry
Sale, Area Manager for Centrac Eng. for v~cation of pedestrian
easement within BanBury. The easement is located ten feet on
either side of the lot line between lots 5 and 6 of "block 1.
After hearing testimony from the applicant and interested paities
and being advised in the matter the Eagle City Council
concluded the following:
FINDINGS OF FACTS AND CONCLUSIONS OF LAW
1.
On September 6, 1988 Eagle Planning and Zoning recommended
approval of the request.
2.
Approval of the application for vacation of easement as it
was caused by the construction of the pedestrian path outside
the easement. .
3.
The purchaser of the lot upon which the trail is located, Mr.
and Mrs. Morgan Masner, and The Hoff Companies, are
cooperating in this request by mutual consent.
4.
The easement will be dedicated to the BanBury Home Owners
Association.
5.
The request and procedures are in compliance with Idaho
State Code 50-1301 through 50-1308, and Eagle City Code 9-6-
6.
That, pursuant to council approval, a Declaration of
Easement will be recorded with the Ada County Recorder by
Centrac Engineering, and subsequently by the City of Eagle..
