FINDINGS OF FACT
1)
On February 8, 1983, Leslie D. Cullen applied for an
amendment to the Eagle Comprehensive Plan in which he requested
that a parcel of land generally described as the West side of
North Eagle Road immediately North of Boise Valley Packing Company
or more specifically described as a portion of the NE 1/4 NE 1/4,
Section 17, T.4N., R.lE., B.M., Eagle, Ada County, Idaho.
In
his application the applicant requested that the parcel of property
be designated industrial in the Eagle City Comprehensive Plan.

On March 1, 1983, following the notice and hearing pro-
cedures required by section 67-6509, Idaho Code, the Eagle Planning
and Zoning Commission recommended that the Eagle City Council
approve the amendment.
3) On May 10, 1983, the Eagle City Council following the
notice and hearing procedures required in section 67-6509, Idaho
Code, voted to approve the proposed amendment.
4)
The proposed amendment is warranted by the desire of
the applicant to relocate his stove and fireplace insert manufacturing
plant from the Eagle City Center to a location more appropriate
and suitable for light to moderate industrial use.
The public
need for and benefit from the proposed change in the plan is that

a proposed amendment will allow this relocation from the central
business district to an area of the city which is immediately
contiguous to an already designated industrial area.
In addition
the testimony of the applicant indicated that the relocation of
the manufacturing plant will allow its expansion and the employment
of between 80 and 100 persons when the plant is in full operation.
5)
Based upon testimony of the applicant it appears that
no other location within the present industrial area of the Eagle
Comprehensive Plan is available to the applicant for the construction
of his proposed manufacturing plant.
6)
Based on presentations made by the applicant and by
James Gipson the land which is the subject of the Comprehensive
Plan Amendment will be utilized for the construction of a new
manufacturing plant for the applicant's stove and fireplace insert
business.
Proposed renderings of the manufacturing plant, which
is to be constructed in two stages, were presented to the City
Council for its review at the time of the hearing.
Based upon the foregoing Findings of Fact the Eagle City
Council at its May 10, 1983, meeting voted to approve the proposed
amendment to the Eagle Comprehensive Plan.

1)
The application of Leslie D. Cullen of February 8, 1983,
complies with the requirements for amending the Eagle Comprehensive
Plan as contained in Annex A to Resolution No. 5-81.

2)
The proposed amendment to the Comprehensive Plan does
not conflict with any other policies contained in the Plan and
conforms to those specific policies of the Plan as specifically
set forth below.
3)
The Employment Center for the Eagle impact area will
include the central business district and the area South of Highway
44 which generally lie within the 1982 Sewer -and Water Planning
limits.
4)
The proposed industrial development contained in the
Application for Amendment to the Plan will not detract from the
natural qualities of the Eagle City environment.
5)
Approval of the amendment furthers the policy of the
City of Eagle in creating its own independent tax base through
a moderate program of economic development.
6)
The policy of the City of Eagle as contained in its
Comprehensive Plan is that the primary location for industrial
development will be South of Highway 44 within less severe areas
of the flood plain.

Moved by STOPPELLO and seconded by HALEY to make the
applicants of Design Review #2-83 Gordon Skinner and David
Slagel dba Auto Enterprises comply with the Design Review
Overlay District, Article 9 of the Zoning Ordinance #40,
on the grounds and for the reasons that it appears that
they fall under Section E., Subsection 1., and that they
will be changing their building when they take down the
plywood to re-insta11 doors. Motion resulted as follows:
