FINDINGS OF FACT
1) On or about June 11, 1984, John Robison and Richard Bechtold
(Applicants) applied for an amendment to the zoning ordinance of the
City of Eagle, Idaho, in which they requested that a parcel of land
located on the West side of Edgewood Lane and Couth of the Eagle Hills
Golf Course and consisting of approximately 9.5 acres be rezoned from
its present Agriculture designation to Residential (R-5).
2) On July 3, 1984, the Eagle Planning and Zoning Commission,
following the notice and hearing procedures required by #67-6509,
Idaho Code, recommended that the Eagle City Council approve the appli-
cation for the amendment to the zoning ordinance. In its Findings of
Fact, the Commission determined that the proper legal requirements
for advertising of the hearing had been fulfilled, that the amendment
of the zoning ordinance from A (Agriculture) to R-5 (Residential)
would not be in conflict with the Eagle Comprehensive Plan and that
the owners of adjacent lands approved of the proposed change and use.
3) The proposed amendment of the City Zoning Ordinance is in
accordance with the adopted Comprehensive Plan of the City of Eagle.
Based upon the foregoing Findings of Fact the Eagle City Council
at its August 14, 1984 meeting voted to approve the proposed amend-
ment to the Eagle City Zoning Ordinance. The approval of this appli-
cation is based upon the following:
CONCLUSIONS OF LAW
1) The application of John Robison and Richard Bechtold of
Jule 11, 1984, complies with the requirements of Article XVII of the
Eagle City Zoning Ordinance which sets forth the requirements for the
contents of an application for the amendment of the Eagle City Zoning
Ordinance. All hearings as required by #67-6509, Idaho Code, and
Article XVII of the Eagle City Zoning Ordinance have been held by the
Eagle City Planning and Zoning Commission and City Council.
2) The ordinance utilized in evaluating the application is the
zoning ordinance of the City of Eagle, Idaho and the standards used
by the Planning and Zoning Commission and the Eagle City Council are
those standards contained in the Eagle City Comprehensive Plan together
with the fact that the proposed amendment to the zoning ordinance is
in accordance with the adopted comprehensive plan.
3) The reasons for the approval of the application to amend the
Eagle City Zoning Ordinance include conformity with the adopted Compre-
hensive Plan, specifically the Purpose and Scope, section E and the
Land Use Map.
