Findings - PZ - 1983 - CUP for 3-2 story townhouses 24 units - Request Does Not Constitute A Cup For Zoning Distr In the Matter of CITY OF EAGLE, IDAHO Applicant ) ) BUILDERS) ) ) FINDINGS OF FACT AND CONCLUSIONS OF LAW ROBERT DESHAZO FINDINGS OF FACT 1) On or about October 31, 1983, Robert DeShazo Builders Inc., applied for a Conditional Use Permit in which it requested that a parcel of property generally described as being on the Southeast corner of the intersection of Ranch Drive and North Eagle Road, Eagle, Idaho, be ~ti1ized for the construction of three two-story townhouses for a total of 24 units. 2) On January 3, 1984, a hearing was held before the Eagle City Planning and Zoning Commission to consider the Robert DeShazo Builders Inc. Conditional Use Permit Application. The Commission, following presentation by Robert Maxey of the plans, voted to deny the application for the following reasons: A. The Conditional Use Permit is not necessary to accomplish what is asked for in the application: and B. The Plans as set forth in the application are not in keep- ing with the Comprehensive Plan of the City of Eagle. Based upon the foregoing Findings of Fact the Eagle City Council at its February 14, 1983, meeting voted to deny the proposed Conditional Use Permit. The denial of this permit is based upon the following: CONCLUSIONS OF LAW 1) The request does not constitute a conditional use as established on the Official Schedule of District Regula- tions for the zoning district involved. 2) The request would not be harmonious with and in accordance with the density allowed in that area under the Compre- hensive Plan; and 3) The use requested would change the essential character of the neighborhood with increased traffic flow and increased density. 4) For the reasons previously stated it is appropriate that a Conditional Use Permit be denied to Robert DeShazo Builders, Inc. based upon those considerations contained in Section C, Article XI of the Eagle City Zoning Ordinance relating to Conditional Use Permits in general.
