ROLL CALL: Present: WRIGHT, GUERBER, JOHNSON, MCLAUGHLIN, and SMITH. A quorum is present. ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA: ♦ Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. ♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of September 3, 2019. B. Findings of Fact and Conclusions of Law for RZ-07-19 — Rezone from R-1 to C -1 -DA Jerron and Margie Porchia: Jerron and Margie Porchia are requesting a rezone from R-1 (Residential) to C -1 -DA (Neighborhood Business District with a development agreement [in lieu of a conditional use permit]) to allow for retail, restaurant, community center, and residential (3- townhomes, 2 single-family dwellings) uses. The 2.56 -acre site is located on the west side of North Horseshoe Bend Road approximately 130 -feet south of intersection of West Bonita Hills Boulevard and North Horseshoe Bend Road at 10201 North Horseshoe Bend Road. ACTION ITEM: CPA-01-19/A-02-19/RZ-05-19/CU-04-19/PPUD-03-19/PP-05-19 — Whitehurst Planned Unit Development — Mustang 35, LLC: Mustang 35, LLC, represented by Mark Butler with Land Consultants, Inc., is requesting a comprehensive plan text amendment, annexation, rezone from RUT (Rural -Urban Transition — Ada County designation) to R -1 -DA -P (Residential with a development agreement — PUD) and R -4 -DA -P (Residential with a development agreement — PUD), conditional use permit, preliminary development plan, and preliminary plat approvals for Whitehurst Subdivision, an 88 -lot (77 -buildable, 9 -common, 2-shared/common driveways) residential planned unit development. The 30.06 -acre site is located at the terminus of West Breanna Drive north of Flint Estates Subdivision. Mark Butler, 1675 East Bishop Way. Studer explains that Mr. Butler has been transparent in his working with the surrounding neighbors and states his appreciation for the accommodations made by the applicant. Studder expresses concerns about the proposed density and traffic. Missy McGrath, 678 North Cove Colony Way. McGrath thanks Mr. Butler for holding the neighborhood meetings, and states her opposition for the application due to the proposed density and traffic. Mike McGrath, 678 North Cove Colony Way. McGrath thanks staff for their hard work, states his opposition for the application, and expresses concerns about how traffic and growth affect quality of life. Monte Chitwood, 354 North Cove Colony Way. Chitwood requests that the Commission follow the densities outlined in the Comprehensive Plan, and expresses concerns about traffic speeds in the Cove Colony Subdivision. Dean Hovde, 408 North Cove Colony Way. Hovde expresses concerns about the density of the proposed application, traffic on Cove Colony Way and surrounding streets, and the design of Fisher Park Way. Tom Brengle, 2475 North Sun Valley Place. Brengle states that he would like to see the Commission adhere to the most -strict interpretation of the Comprehensive Plan, and inquires about the planned unit development aspect of the application. Jim Magdich, 515 North Cove Colony Way. Magdich comments on the copy quality of the public hearing notice and inquires about the location of the pump house adjacent to his property. Magdich also states that he would like to see the project redesigned to meet the goals of the Comprehensive Plan Jana Ronsse, 3348 West Sky Wood Lane. Ronsse expresses concerns about traffic congestion in the area, and the impact of traffic and additional roadways in the area. Skye Hamilton, 3660 West Flint Drive. Hamilton commends Mr. Butler for the neighborhood meetings and his transparency, and states her opposition for the project based on the density. Hamilton expresses her displeasure regarding the approval of the Bellemeade Subdivision, and states that she does not believe the proposed density of this application fits within the surrounding area. Ceilie Robertson, 2957 West Colony Court. Robertson expresses concerns about traffic and safety in the area, expresses concerns about the smaller lot sizes that have been approved in the area, and asks the Commission to reconsider the R-4 portion of the plan. Kim Washburn, 3855 West Flint Drive. Washburn cautions the Commission to take into consideration development that has already taken place in the area and the impact of additional traffic that would be generated by this application. Becky McKay, 1100 East Valli -Hi Drive. McKay, the applicant's engineer, provides input about the location of the project, required improvements, the cost of repairs to required improvements, and explains that the Comprehensive Plan identifies greater density adjacent to the high school and speculates that the same would be true adjacent to the park site if the site had been planned when the Comprehensive Plan was developed. Marcie Carter, 3000 East Colony Court. Carter expresses concerns about traffic, density, and roundabouts in the area. Tim Ronsse, 3348 West Sky Wood Lane. Ronsse provides rebuttal to Ms. McKay's comments regarding the roundabout and truck/trailer traffic on Fisher Park Way and Flint Drive. The applicant's representative provides rebuttal and responds to concerns raised during the Public Hearing.
